WBN Terrorism, Political Violence & Active Assailant
Comprehensive global protection against evolving threats, tailored for WBN members.
Miller continues to be at the forefront of the London market’s evolving cover for terrorism, political violence and active assailant risks.
Our terrorism and political violence team can help you navigate the diversifying risk environment and advise on a range of solutions that protect property, finances and people, and help to mitigate risk.
Terrorism & political violence solutions
We secure a range of coverages on a standalone or combined package basis for organisations operating anywhere in the world. These include:
- Acts of terrorism
- Alternatives to TRIA and TRIA captive wrap
- Nuclear, chemical, biological or radioactive weapons (NCBR)
- Malicious damage
- Sabotage
- Strikes, riots & civil commotion
- Insurrection, revolution or rebellion
- Mutiny, coup d’état
- War on land and civil war
For clients with assets, investments or exposures in the developing world, wider political violence and political risk coverage should also be considered in these territories.
Admitted global programme structures
Miller can place programmes which combine a blend of direct admitted coverages with reinsurances of fronted local placements. The ‘master’ policy also wraps around any local coverage purchased on a difference in conditions and difference in limits basis to ensure that there are no gaps.
Active assailant
For North American brokers, Miller can offer access to dedicated Active Assailant insurance.
Why you may not already be covered
Commercial general liability
Although active assailant incidents may not be expressly excluded from your general liability policy, there may be no affirmative cover either. Our policy responds as primary, does not require negligence to be proven, and protects your general liability program from a random, unpredictable incident. It also provides crisis management, PR, and counselling costs, which a general liability policy would not.
Workers’ compensation
This coverage may not respond unless the motivation of the attack is related to the workplace. It is also unlikely to respond or cover visitors, guests, or customers on the property. Typically, workers’ compensation coverage will also not reimburse extra expenses to recruit or train new employees replacing those unable to continue working after an attack. Salary continuation benefits are also state specific and generally speaking, do not fully indemnify the victims. Our policy provides a clearly defined personal accident benefit.
Property
Traditional cover requires physical damage to respond, whereas our policy includes non-physical damage and business interruption following a threat. Cover also extends to cover business interruption following an incident at a neighbouring property, restricted ingress / egress or loss of attraction.
TRIA
Only responds if an incident generates at least USD5m in property and casualty losses and is deemed a Certified Terrorist Attack by the U.S. Secretary of the Treasury, the Attorney General, and the U.S. Secretary of Homeland Security. To date, there has been no event certified since 9/11.
How we can help transfer your risk
To best match a client’s needs and risk transfer appetite, all our policies are bespoke to include any of the following:
- Legal liability
- Personal accident benefit for those injured / killed
- Threat response, including costs of a threat assessment and temporary additional security measures
- Hostage response, including fees of negotiators/translators and salary of those involved with negotiations
- Fees and expenses of response consultants
- Related expenses following an incident
- Property damage
- Loss of earnings (temporary closure or denial of access, loss of attraction and ingress/egress)
All policies are designed to respond irrespective of motivation, without the need for physical damage, and address the changing nature of attacks whereby they can quickly develop into a hostage scenario.
