Reforms to insurance law: briefing call to Airmic members

Miller recently participated in a briefing call to Airmic members on the Law Commission’s proposed reforms to insurance contract law (the Marine Insurance Act 1906) and the issue of non-disclosure and warranties.

The proposals, released by the Law Commission on the 26 June 2012, recommend a radical new approach to dealing with problems arising from non-disclosure of material information in commercial insurance contracts.

During the briefing, David Hertzell, the Law Commissioner for England and Wales outlined the new proposals with Alex Oddy, partner at law firm Herbert Smith reviewing the legal implications for buyers. Representing the insurance market were Sue Taylor from Miller and Noona Barlow from Chartis, who presented the broker and insurer perspectives. All parties welcomed the proposals as they’ll bring clarity around the process.
